Abstract

Kredit bermasalah (non-performing loan) pada Bank Badan Usaha Milik Negara (BUMN) sering kali dipandang sebagai persoalan keperdataan antara bank dan debitur. Namun dalam praktiknya, kredit bermasalah tertentu justru melibatkan penyalahgunaan kewenangan, manipulasi dokumen, dan rekayasa agunan yang berimplikasi pada kerugian keuangan negara. Artikel ini bertujuan untuk menganalisis kedudukan kredit bermasalah pada Bank BUMN dalam perspektif hukum pidana korupsi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa kredit bermasalah pada Bank BUMN dapat dikualifikasikan sebagai tindak pidana korupsi apabila dalam proses pemberian, pencairan, atau pengelolaannya terdapat perbuatan melawan hukum, penyalahgunaan wewenang, dan niat jahat yang mengakibatkan kerugian keuangan negara. Dengan demikian, hubungan hukum yang semula bersifat perdata dapat bergeser menjadi ranah hukum pidana khusus.
