Abstract

The Regional Representative Council (Dewan Perwakilan Daerah/DPD) was established as a regional representative institution whose members are directly elected by the people, thereby possessing strong democratic legitimacy from a normative perspective. Nevertheless, in the practice of Indonesia’s constitutional system, the legislative authority of the DPD remains highly limited and is strictly confined to the discussion of certain bills related to regional affairs. This restriction creates a significant gap between the political legitimacy of the DPD and the constitutional role it performs, resulting in the suboptimal functioning of regional representation. In fact, every statute enacted at the national level inherently has direct or indirect implications for regions as constituent elements of the state. This study aims to analyze the weaknesses of the DPD’s authority in the law-making process and to present conceptual arguments regarding the urgency of strengthening the DPD’s role within the national legislative system. The findings indicate that the weak position of the DPD is primarily caused by a minimalist design of its constitutional powers and the dominance of the House of Representatives (DPR) in legislative mechanisms. Therefore, strengthening the authority of the DPD is an urgent necessity to establish a more balanced system of checks and balances, either through the involvement of the DPD in all legislative processes despite the absence of voting rights, or through the granting of stronger authority, such as a limited veto right, with respect to laws directly related to regional interests. Such strengthening is expected to ensure that national policies genuinely reflect the interests of all regions within the framework of the Unitary State of the Republic of Indonesia. This research employs a normative juridical method using statutory, conceptual, and Constitutional Court decision approaches. It is prescriptive in nature and aims to provide legal prescriptions for the issues examined.
