Abstract

This research is motivated by the emergence of the amendment to Article 228A of the Rules of Procedure of the House of Representatives (DPR), which grants the DPR the authority to conduct evaluations of state officials outside the legislature’s internal environment. This provision raises issues concerning the limits of the DPR’s authority and its conformity with Law Number 17 of 2014 concerning the MPR, DPR, DPD, and DPRD. The purpose of this research is to examine the problems surrounding the DPR’s authority to evaluate state officials from the perspective of checks and balances and to analyze the legal implications of such evaluative authority on the independence of state institutions. The research method employed is legal research with a normative juridical approach, utilizing statutory and conceptual approaches. The legal materials used consist of primary, secondary, and tertiary legal sources. The research findings show that the evaluative authority over state officials as provided in Article 228A is inconsistent with the concept of checks and balances because: (1) It is incompatible with the theoretical concept of checks and balances; (2) It contradicts the rule of law principle adopted by Indonesia; (3) It creates the potential for abuse of power—an issue the checks and balances mechanism is designed to prevent; and (4) It fails to provide legal certainty. The legal implication of Article 228A of the DPR Rules of Procedure is that it violates the principle of institutional independence, as the DPR expands its control over other state institutions without clear parameters for conducting evaluations. Therefore, the DPR needs to review Article 228A of its Rules of Procedure to ensure alignment with the checks and balances principle. The Rules of Procedure should not serve as a basis for creating new powers; instead, they should function solely as internal guidelines for the execution of authorities already established by statute. It is essential to define clear boundaries, mechanisms, and objective, transparent, and accountable indicators for evaluating state officials so that the principle of institutional independence is preserved.
