Abstract

This study focuses on analyzing the legal status of sound horeg performance agreements and legal protection for victims who suffer material and immaterial losses as a result of these activities. The phenomenon of sound horeg as a form of entertainment in East Java and Central Java often has negative impacts in the form of noise, social conflict, and disturbances to public order. The legal issue that arises is the absence of specific regulations regarding sound horeg in Indonesian positive law, which causes a conflict between the freedom of contract as stipulated in Article 1338 of the Civil Code and various restrictions regulated by East Java Regional Regulation No. 1 of 2019 in conjunction with No. 2 of 2020 and the Joint Circular Letter of the Governor of East Java of 2025. This study uses a normative juridical approach with a library research method, through analysis of the Civil Code, regional regulations, circular letters, and East Java MUI Fatwa No. 1 of 2025, which confirms the prohibition of activities that cause harm (la dharar wa la dhirar). The results of the study show that sound horror show agreements made before the ban was in place are still valid under civil law, but their implementation may be hindered by public law. Victims are entitled to legal protection and compensation, both material and immaterial, in accordance with Article 1365 of the Civil Code. In conclusion, civil law and public law must be balanced in order to create justice, legal certainty, and protection for the affected community.
