Abstract

Gender inequality in customary inheritance systems remains a critical issue in several regions of Indonesia, including Ende Lio Regency, East Nusa Tenggara. The Ende Lio community adopts a patrilineal inheritance system that prioritizes male heirs especially the eldest son while women are often excluded or given unequal inheritance rights. This study aims to examine the forms of legal protection for women as heirs within that system. A normative juridical method was used, with statutory and conceptual approaches, supported by legal literature and analysis of relevant regulations. The findings show that although customary law places men in a dominant position, there is room for legal reconstruction by integrating principles of equality and human rights. The study concludes that legal protection for female heirs can be pursued through harmonization of customary and national law, and through legal recognition of court decisions that uphold justice and gender equality.
