Abstract

Account blocking is an administrative measure used to prevent money laundering and other financial crimes. In practice, the account blocking policy implemented by the Financial Transaction Reports and Analysis Center (PPATK) raises legal issues, particularly when applied to dormant accounts that show no transaction activity or clear indications of criminal activity. In practice, the account blocking policy by the Financial Transaction Reports and Analysis Center (PPATK) raises legal issues, particularly when applied to dormant accounts that show no transaction activity or clear indications of criminal activity. This situation has the potential to restrict citizens' rights to their funds without a clear basis of authority. This research is a normative legal study with a legislative and conceptual approach that aims to analyze the validity of PPATK's authority to block accounts and its implications for the principle of legality and the protection of the constitutional rights of account owners based on Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes. The results of the study show that the PPATK's authority is normatively limited to requesting the temporary suspension of financial transactions suspected of being related to criminal acts, as part of its financial analysis and intelligence functions, while the authority to block accounts entirely lies with investigators, public prosecutors, or judges in accordance with procedural law provisions. Therefore, the practice of blocking accounts without the involvement of law enforcement officials has the potential to create legal uncertainty and is contrary to the principle of legality and the principle of protection of constitutional rights. This study emphasizes the need for clearer regulations regarding the criteria and procedures for handling dormant accounts in order to maintain a balance between the interests of preventing crime and protecting the rights of citizens within the framework of modern Indonesian rule of law.
