Abstract

Putusan Mahkamah Konstitusi Nomor 65/PUU-XXI/2023 menandai pergeseran penting dalam pengaturan kampanye politik di lembaga pendidikan, dari larangan absolut menuju kebolehan bersyarat. Putusan ini menimbulkan perdebatan yuridis mengenai konsistensinya dengan prinsip netralitas lembaga pendidikan sebagai institusi publik yang berfungsi menjaga kebebasan akademik dan integritas proses pendidikan. Artikel ini bertujuan untuk menganalisis pertimbangan hukum Mahkamah Konstitusi dalam menafsirkan larangan kampanye politik di lembaga pendidikan serta menilai kesesuaiannya dengan prinsip netralitas institusi pendidikan dalam kerangka hukum tata negara Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan pendekatan kasus melalui telaah Putusan Mahkamah Konstitusi Nomor 65/PUUXXI/2023. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi menerapkan pendekatan proporsionalitas dengan menyeimbangkan hak politik warga negara dan kewajiban negara dalam melindungi fungsi pendidikan dari intervensi politik praktis. Mahkamah menegaskan bahwa kegiatan politik di lembaga pendidikan hanya dapat dibenarkan apabila bersifat edukatif, nondiskriminatif, serta tidak mengandung ajakan elektoral. Namun demikian, penafsiran bersyarat tersebut berpotensi menimbulkan ketidakpastian hukum dan membuka ruang multitafsir dalam implementasinya, khususnya terkait batas antara pendidikan politik dan kampanye elektoral. Oleh karena itu, penguatan regulasi teknis dan pedoman pengawasan menjadi kebutuhan mendesak guna memastikan prinsip netralitas lembaga pendidikan tetap terjaga tanpa mengabaikan hak konstitusional warga negara dalam memperoleh informasi politik.
