Abstract

Tanggung jawab sosial dan lingkungan perusahaan (CSR) di Indonesia telah berkembang dari sekadar komitmen moral menjadi kewajiban hukum sebagaimana diatur dalam Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas dan diperkuat oleh Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Namun, praktik implementasinya masih menghadapi berbagai kendala, mulai dari sifat administratif program CSR hingga minimnya keterlibatan masyarakat lokal. Pelanggaran kewajiban CSR bahkan kerap menimbulkan pencemaran lingkungan, konflik sosial, dan penurunan kualitas hidup masyarakat sekitar. Artikel ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta menelaah beberapa kasus pelanggaran CSR di Indonesia. Hasil kajian menunjukkan bahwa sanksi hukum, baik administratif, perdata, maupun pidana, merupakan instrumen penting dalam memastikan kepatuhan korporasi. Efektivitas sanksi hukum masih terbatas akibat lemahnya penegakan dan kompleksitas pembuktian, meskipun beberapa putusan pengadilan telah menerapkan prinsip strict liability terhadap perusahaan. Oleh karena itu, penguatan regulasi, konsistensi penerapan sanksi, serta pengawasan yang transparan menjadi syarat utama agar sanksi hukum benar-benar mampu menegakkan tanggung jawab sosial dan lingkungan perusahaan secara substantif dan berkeadilan.
