Abstract

The regulatory reform in the land administration sector through the issuance of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Number 16 of 2021 has created legal consequences for the status of Petok D as an administrative document of land possession. Petok D has undergone a functional shift within the modern land registration system, which emphasizes legal certainty and the digitalization of land certificates. This research aims to analyze the legal standing of Petok D following the enactment of ATR/BPN Regulation Number 16 of 2021 and to explain the process of converting Petok D into an electronic land certificate along with its legal implications. This study employs a normative juridical method using both a statute approach and a conceptual approach. Legal materials were analyzed qualitatively by examining provisions contained in the Basic Agrarian Law (UUPA), Government Regulation Number 24 of 1997, Government Regulation Number 18 of 2021, ATR/BPN Regulation Number 16 of 2021, and other regulations supporting the digitalization of land certificates. The research findings indicate that Petok D no longer serves as an independent proof of land ownership, yet it remains recognized as a transitional administrative document in the initial land registration process. Such recognition is limited and must be accompanied by physical and juridical verification by the Land Office. The conversion of Petok D into an electronic land certificate is carried out through several stages, including data validation, physical possession verification, land parcel measurement, juridical data determination, and issuance of the electronic certificate within the digital land administration system. The study also finds that land administration digitalization improves legal certainty, transparency, and efficiency; however, it still faces challenges related to public digital literacy and infrastructure readiness.
