Abstract
The establishment of the Constitutional Court's rules of procedure is a fundamental aspect in maintaining legal certainty, consistency, and accountability in the constitutional case review process. Currently, provisions regarding the procedural law of the Constitutional Court are scattered throughout Law No. 24 of 2003 on the Constitutional Court and its amendments, and are regulated in more technical detail through Constitutional Court Regulations (PMK). This fragmentation of regulations has given rise to dynamics and problems, particularly in relation to the delegation of authority to the Constitutional Court to create its own procedural law through Constitutional Court Regulations and the position of Constitutional Court Regulations as internal rules that often contain quasi-legislative norms. This study aims to examine, first, how the procedural law of the Constitutional Court is regulated in Law Number 24 of 2003 and, second, considerations regarding the construction of the procedural law of the Constitutional Court within the framework of a separate law. This study uses a normative juridical method through a legislative approach, a conceptual approach, and a comparative study of the practice of procedural law regulation in several countries with a constitutional court model. The results of the study show that Law Number 24 of 2003 and its amendments do not comprehensively regulate procedural law, so many technical aspects are formulated through Constitutional Court Regulations. This condition has led to the potential expansion of the Constitutional Court's authority and raised the issue of accountability in the formation of procedural law norms. Furthermore, the study found that the formation of a separate law on the procedural law of the Constitutional Court is a constitutional urgency to ensure standard procedural norms, increase legislative transparency, and strengthen the legitimacy of the constitutional trial process. The law needs to cover the principles of due process of law, standards of public participation, mechanisms of evidence, regulations on case settlement, and limitations on the normative authority of the Constitutional Court in formulating technical rules.
