Abstract

Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Sentencing in Corruption Crimes was issued to address the disparity in sentencing for corruption crimes that often occurs in judicial practice, because differences in interpretation and considerations by judges lead to inconsistent sentences that give rise to legal uncertainty. However, its existence raises questions regarding the limits of the Supreme Court's authority as a judicial institution, particularly because the sentencing guidelines relate to criminal law material that should be regulated by law, not through judicial regulations. Based on a normative juridical approach, this study shows that the Supreme Court is, in principle, only authorized to establish technical judicial regulations, so that when the Supreme Court Regulation contains substantive provisions regarding sentencing, this has the potential to exceed the limits of authority granted by law. Therefore, the most appropriate solution is to take the judicial review mechanism against the Supreme Court Regulation that regulates the guidelines for sentencing, in order to assess its conformity with the Corruption Eradication Law as well as with the principle of the hierarchy of laws and regulations and the constitutionality of the authority of the person forming it, so that it can be ensured that the existence of the Supreme Court Regulation does not give rise to legal or constitutional problems in judicial practice.
