Abstract

Tindak pidana pemerkosaan merupakan bentuk kejahatan seksual yang berdampak serius terhadap martabat dan hak asasi manusia korban. Namun demikian, konstruksi hukum dan praktik penegakan hukum di Indonesia masih cenderung memusatkan perhatian pada korban perempuan, sehingga keberadaan korban laki-laki kerap terabaikan. Penelitian ini bertujuan untuk mengkaji perbedaan karakteristik pemerkosaan terhadap laki-laki dan perempuan, khususnya terkait unsur pemaksaan, pembuktian, serta bentuk perlindungan hukum dalam hukum pidana Indonesia berdasarkan Pasal 473 Kitab Undang-Undang Hukum Pidana Tahun 2023. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, dengan menganalisis ketentuan hukum pidana, doktrin hukum, serta pandangan akademisi terkait perlindungan korban pemerkosaan. Hasil penelitian menunjukkan bahwa Pasal 473 KUHP 2023 telah memberikan pengakuan normatif terhadap laki-laki sebagai korban pemerkosaan melalui penggunaan frasa “setiap orang”, namun masih terdapat kelemahan dalam perumusan unsur pemaksaan yang cenderung berorientasi pada kekerasan fisik, sehingga berpotensi menyulitkan pembuktian pada kasus korban laki-laki. Selain itu, perlindungan hukum terhadap korban masih menghadapi hambatan dalam praktik, khususnya terkait stigma sosial dan keterbatasan mekanisme pemulihan korban. Bentuk perlindungan hukum represif yang tersedia bagi korban pemerkosaan meliputi penjatuhan sanksi pidana terhadap pelaku sebagai wujud pertanggungjawaban hukum, serta pemenuhan hak korban melalui restitusi, bantuan medis, dan rehabilitasi psikososial. Oleh karena itu, diperlukan penguatan regulasi dan kebijakan pendukung agar perlindungan hukum terhadap korban pemerkosaan, baik laki-laki maupun perempuan, dapat terwujud secara adil, efektif, dan berperspektif hak asasi manusia.
