Abstract

Hak atas kesehatan merupakan hak konstitusional warga negara yang dijamin dalam Undang-Undang Dasar Negara Republik Indonesia 1945. Sebelumnya, jaminan pemenuhan hak tersebut diperkuat melalui kebijakan mandatory spending di bidang kesehatan sebagaimana diatur dalam UndangUndang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Namun, berlakunya Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan menghapus ketentuan mandatory spending, sehingga menimbulkan persoalan yuridis terkait kepastian pemenuhan hak konstitusional atas kesehatan. Artikel ini bertujuan untuk menganalisis makna hak konstitusional warga negara atas kesehatan dalam perspektif UUD NRI 1945 serta mengkaji implikasi yuridis penghapusan mandatory spending terhadap jaminan pemenuhannya. Hasil kajian menunjukkan bahwa penghapusan mandatory spending berpotensi melemahkan kepastian hukum dalam pemenuhan hak atas kesehatan dan berisiko menimbulkan ketimpangan akses pelayanan kesehatan, khususnya bagi kelompok rentan
