Abstract

Tujuan dari penelitian ini adalah untuk mengetahui terkait dengan ketiadaan pengaturan mengenai larangan rangkap jabatan Pimpinan/Ketua Partai Politik sebagai Pejabat Eksekutif dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang turunannya dengan menjelaskan urgensi diaturnya mengenai larangan rangkap jabatan Pimpinan/Ketua Partai Politik sebagai Pejabat Eksekutif. Penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Hasil dari penelitian ini menjukkan bahwasaannya ketiadaan pengaturan mengenai larangan rangkap jabatan Pimpinan/Ketua Partai Politik sebagai Pejabat Eksekutif dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang turunannya. Urgensi pengaturan larangan rangkap jabatan pimpinan/ketua partai politik sebagai pejabat eksekutif, yaitu untuk: (1) Menciptakan Tata Kelola Pemerintahan yang Baik dan Bersih (good and clean governance), (2) Mencegah Terjadinya Konflik Kepentingan (conflict of interest), (3) Mencegah Penyalahgunaan Kekuasaan dan Tindakan Sewenang-wenang (abuse of power), (4) Menjaga Netralitas Pejabat Eksekutif sebagai Pejabat Publik, (5) Menegakan Prinsip Konstitusionalisme, (6) Mewujudkan Kepastian Hukum, dan (7) Mencegah Otoritarianisme.
