Abstract

Inflasi medis yang sangat tinggi dan berkepanjangan di Indonesia membuat pembayaran klaim asuransi kesehatan swasta diubah dengan model Co-Payment sebesar 10% oleh Surat Edaran Otoritas Jasa Keuangan Nomor 7 Tahun 2025 (SE OJK 7/25), hal ini membuat permasalahan hukum terkait dengan perlindungan hukum terhadap konsumen asuransi kesehatan dan teori kepastian hukum. Penelitian ini mempunyai tujuan untuk menganalisis bentuk perlindungan hukum terhadap konsumen asuransi swasta jika dikaitkan dengan permasalahan ini, sekaligus ditinjau dari perspektif teori kepastian hukum. Metode penelitian yang digunakan adalah penelitian hukum normatif, dengan pendekatan perundang-undangan dan konseptual. Bahan hukum yang dipergunakan pada penelitian ini meliputi bahan hukum primer, sekunder dan tersier yang dikaji secara seksama. Hasil penelitian mempertunjukkan bahwa perubahan isi polis oleh SE OJK 7/25 bertentangan dengan perundang-undangan yang memuat materi perlindungan hukum terhadap konsumen asuransi kesehatan dan kontradiksi terhadap teori kepastian hukum yang ada.
