Abstract

This research discusses the legal position of freelance workers as concurrent creditors in bank ruptcy proceedings. Freelance workers, as service providers without an employment relations hip with the company, have the right to receive payment for their services. However, in bankr uptcy proceedings, freelance workers face limitations as concurrent creditors. This research an alyzes the legal position of freelance workers in bankruptcy proceedings and how their rights are protected. The results show that freelance workers have a weak position as concurrent cre ditors and need better legal protection to ensure their rights are fulfilled. This research uses a normative legal research method by analyzing the applicable laws and regulations in Indonesia, specifically Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligatio ns (UUK-PKPU). The results show that freelance workers as concurrent creditors have limite d rights in bankruptcy proceedings, such as lower payment priority compared to separatist and preferred creditors. This research also finds that freelance workers need better legal protection to ensure their rights are fulfilled in bankruptcy proceedings. Thus, this research is expected to contribute to the development of bankruptcy law in Indonesia, particularly regarding the pro tection of freelance workers' rights. This research employs normative legal research with a prescriptive nature aimed at providing legal prescriptions for the issues examined.
