Abstract

The development of digital technology has led to the emergence of new assets with economic value, one of which is social media accounts like TikTok. TikTok accounts no longer serve merely as platforms for entertainment and communication but have evolved into business instruments and income sources through content monetization, endorsements, and commercial collaborations. The economic value embedded in TikTok accounts raises new legal issues, particularly regarding the possibility of using TikTok accounts as debt collateral within the perspective of Indonesian collateral law. This research aims to analyze the legality of TikTok accounts as objects of fiduciary security interests and to examine the execution mechanism in case of default. The research method employed is normative legal research with a statutory and conceptual approach. The findings indicate that conceptually, TikTok accounts can be classified as intangible movable property with economic value, making them potential objects for fiduciary security interests, particularly through protection of economic rights over content. However, their implementation faces various challenges, such as the absence of explicit regulations, difficulties in economic valuation, dependency on platform policies, and complexities in execution mechanisms. Therefore, regulatory updates and harmonization of collateral law, strengthened execution mechanisms for digital assets, and comprehensive contractual clauses are needed to ensure that the utilization of TikTok accounts as debt collateral provides legal certainty and protection for all parties involved.
