Abstract

This study aims to analyze the legal validity of interfaith marriages conducted abroad under Indonesian marriage law and the juridical implications of marriage registration or non-registration on the legal status of spouses, the rights and obligations of children, and the regulation of marital property. This research employs normative legal research using statutory and doctrinal approaches. The findings indicate that Indonesian marriage law firmly upholds Article 2 of Law Number 1 of 1974 on Marriage as the primary basis for marital validity, requiring that a marriage be conducted in accordance with the religious laws of the parties and be officially registered by the state. Accordingly, Article 56 of the Marriage Law cannot be used to legitimize interfaith marriages conducted abroad when such marriages contravene the principles of validity under Indonesian national law. The use of Article 56 as a legal loophole risks creating legal uncertainty and adversely affects the civil law status of children and the regulation of marital property. This study emphasizes the importance of consistently enforcing Article 2 of the Marriage Law to ensure legal certainty and uphold public order within the Indonesian marriage law system.
