Abstract

The regulation in Article 156a of the Criminal Code, which is expected to maintain a person's faith or religion, actually contains the same norms. Such as the interpretation or or interpretation of the norms of Article 156a of the Criminal Code in relation to "blasphemy". This can provide uncertainty in the implementation by law enforcement officials in its implementation. This research is a normative research with a legislative approach and a conceptual approach, as well as jurisprudence analysis which of course is processed by legal interpretation, harmonization of norms and legal findings. The results of the study show that the understanding of the norm of blasphemy or blasphemy in a religion must be understood more in terms of the impact in public and intentions, as well as the form of punishment by prioritizing the principle of ultimum remendium, which is to reprimand or warning efforts at the beginning. So, prison sentences can be a criminal effort.
