Abstract

This study aims to analyze the legal provisions and mechanisms for granting marriage dispensation for children under 18 years of age in Indonesia and to examine the suitability of the practice of granting child marriage dispensation with the principles of child protection. The granting of child marriage dispensation in Indonesia is regulated in Law Number 16 of 2019 and can only be granted if there are urgent reasons. Social phenomena, such as premarital pregnancy and cultural pressures, give rise to a dilemma between legal compliance and the protection of children's rights. This study aims to analyze the judicial practice of child marriage dispensation in the Surabaya Religious Court through a case study of Decisions Number 5 / Pdt.P / 2025 / PA.Sby and Number 2194 / Pdt.P / 2024 / PA.Sby. The research method uses a descriptive qualitative approach with an analysis of court decision documents and the regulation of marriage dispensation based on Law Number 16 of 2019 concerning Marriage. The results of the study indicate differences in the focus of judges' considerations. In case 5/Pdt.P/2025, the dispensation was granted due to pregnancy, with the primary considerations being the protection of the child and the unborn child, reducing social stigma, and ensuring the child's education. In contrast, case 2194/Pdt.P/2024 emphasized the family's social and cultural reasons without any urgent biological conditions, resulting in more limited attention to the child's educational and psychological rights. Both cases highlight the limitations of professional psychological assessments, the minimal involvement of child protection agencies, and varying interpretations of "urgent reasons." This study emphasizes the need for more detailed operational guidelines, transparent documentation of judges' deliberations, and a multidisciplinary approach to ensure that marriage dispensations consistently align with the principle of the best interests of the child. These findings can inform national policy reform, strengthen post-decision oversight, and educate the public about child marriage dispensations.
