Abstract

The supervision of police authority in the use of force, particularly regarding the shooting of suspects, is closely related to the principles of human rights. Indonesia, as a state governed by law, upholds the principle of the presumption of innocence and the protection of the right to life, which must be respected by all law enforcement officers, including the police. This research aims to identify, understand, and analyze the legal consequences of police officers shooting suspects within the perspective of human rights. In addition, this study analyzes the limitations of police authority in conducting “shoot on sight” actions from a human rights standpoint. This study employs normative legal research methods with two approaches: the statute approach and the conceptual approach. The results show that police officers' actions of shooting suspects can lead to serious legal consequences if conducted without a real and immediate threat to the lives of officers or the public. The right to life is a fundamental, non-derogable right under any circumstances, as regulated in the 1945 Constitution, the Human Rights Law, and the ICCPR. Abuse of this authority may result in criminal, civil, and ethical sanctions. The use of force by the police is strictly limited by the principles of necessity, proportionality, and accountability, as regulated in the Police Law and internal police regulations. Furthermore, the public is legally entitled to report such violations to the National Human Rights Commission (Komnas HAM).
