Abstract

The resolution of medical disputes in Indonesia has undergone changes in legal regulation following the enactment of Law Number 17 of 2023 on Health, which requires a recommendation from the Professional Discipline Council (Majelis Disiplin Profesi / MDP) as a prerequisite for the investigation of alleged medical malpractice. This provision has given rise to juridical debates, particularly concerning the legal standing and evidentiary strength of MDP recommendations as a means of proof, as well as their implications for the principle of equality before the law. The issues examined in this study concern the juridical basis of the MDP’s authority to issue recommendations and the involvement of the MDP in the resolution of medical disputes when viewed from the perspective of equality before the law. This research employs a normative juridical method with statutory, conceptual, and comparative approaches. The findings indicate that MDP recommendations have a valid legal basis and may be positioned as documentary evidence or preliminary evidence in legal proceedings, although they are not absolutely binding. On the other hand, the obligation to await an MDP recommendation prior to investigation has the potential to create procedural injustice and hinder access to justice for victims if it is not accompanied by transparent, accountable, and timely mechanisms. Therefore, this study concludes that strengthening regulations concerning the legal standing of MDP recommendations as evidence and restructuring procedures to ensure a balanced protection of both medical professionals and patients are urgently needed in order to maintain legal certainty and uphold the principle of equality before the law.
