Abstract

People with disabilities are a diverse group of people, including people with disabilities who experience physical disabilities, mental disabilities, sensory disabilities, or a combination of physical and mental disabilities. With many people with disabilities in Indonesia who are still unemployed. And there is still discrimination by non-disabled employees so that it is one of the unfulfilled rights of persons with disabilities. After the existence of Law Number 8 of 2016 concerning Persons with Disabilities, the law explains that persons with disabilities have the same rights to participate in social, political, economic and cultural life. They must have equal access to various aspects of life without any barriers caused by their disabilities. So the purpose of this research is to find out the supervision of the fulfillment of the rights of workers with disabilities and to find out the legal remedies that can be taken by workers with disabilities whose rights are not fulfilled. This research uses an normative juridical method with several approaches, namely a statutory approach, a conceptual. The result of this research is that the Government provides protection for persons with disabilities, with the hope that persons with disabilities can also get their basic rights as humans such as getting education, health facilities, and also jobs to improve their standard of living. Population and Civil Registration Office is one that has workers with disabilities. But Population and Civil Registration Office does not have or make policies for its workers with disabilities. So if the rights of workers with disabilities are not fulfilled, it can involve various stages, ranging from internal settlement, mediation, to court. It is important for workers with disabilities to understand their rights and utilize available legal mechanisms, with support from labor inspectors, legal aid agencies, or advocacy organizations.
