Abstract

Abortion based on fetal Down Syndrome diagnosis raises legal dilemmas in Indonesia, conflicting with Law Number 17 of 2023 on Health and Government Regulation Number 28 of 2024. The research problems are: (1) Can Down Syndrome diagnosis serve as a valid reason for abortion? (2) What forms of hospital liability apply to such actions?. This normative research employs statutory and conceptual approaches. The discussion reveals that Down Syndrome does not qualify as a medical emergency or rape-related pregnancy, rendering abortion on this basis illegal (abortus provocatus criminalis). Hospitals may face criminal liability (corporate criminal liability), civil liability (unlawful acts and vicarious liability), and administrative sanctions (warnings to license revocation). The conclusion emphasizes balancing women's reproductive rights and fetal right to life. Recommendations include technical guidelines on severe congenital defects, independent ethics committees, and neutral genetic counseling to prevent malpractice.
