Abstract

Penelitian ini bertujuan untuk menganalisis persyaratan usia minimal dalam rekrutmen tenaga kerja dari perspektif asas kesetaraan menurut Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Metode penelitian yang digunakan adalah penelitian hukum normatif, dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa pengaturan usia kerja dalam UU Ketenagakerjaan mengandung ketidakkonsistenan, terutama antara definisi anak (di bawah 18 tahun) dan pengecualian yang memperbolehkan anak usia 13–15 tahun untuk melakukan pekerjaan ringan. Konflik norma ini menimbulkan ketidakpastian hukum dan berpotensi menciptakan diskriminasi tidak langsung terhadap pekerja muda dalam proses rekrutmen. Lebih lanjut, penetapan batas usia minimal yang diterapkan secara kaku dan tidak transparan oleh perusahaan cenderung bertentangan dengan prinsip kesetaraan, non-diskriminasi, serta hak asasi manusia atas pekerjaan. Penelitian juga mengungkap bahwa hukum ketenagakerjaan Indonesia belum sepenuhnya selaras dengan standar internasional ILO, khususnya Konvensi No. 138 tentang Usia Minimum Bekerja dan Konvensi No. 111 tentang Diskriminasi dalam Pekerjaan. Oleh karena itu, diperlukan harmonisasi dan penajaman regulasi usia kerja agar lebih proporsional, kontekstual, serta menjamin kepastian hukum dan keadilan bagi seluruh tenaga kerja, terutama kelompok usia muda.
