Abstract

Penelitian ini bertujuan menganalisis praktik merariq dalam masyarakat adat Sasak dari perspektif hak asasi manusia (HAM) dan perlindungan hukum terhadap perempuan dan anak. Digunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan budaya, serta bahan hukum primer dan sekunder yang dikumpulkan melalui studi kepustakaan (library research). Dalam menganalisis persoalan hukum digunakan penalaran hukum (legal reasoning) secara deduktif untuk menguraikan kesesuaian praktik merariq dengan prinsip-prinsip hak asasi manusia dan norma perlindungan perempuan serta anak. Hasil penelitian menunjukkan bahwa praktik merariq pada sebagian masyarakat Sasak tidak lagi sepenuhnya mencerminkan nilai adat yang menjunjung persetujuan, penghormatan, dan musyawarah keluarga. Dalam sejumlah kasus, merariq dilakukan tanpa persetujuan bebas perempuan atau bahkan melibatkan anak di bawah umur, sehingga menimbulkan potensi pelanggaran hak atas kebebasan pribadi, perlindungan dari kekerasan, serta hak memperoleh pendidikan dan perkembangan yang layak. Praktik demikian bertentangan dengan prinsip kesetaraan dan perlindungan terhadap perempuan dan anak sebagaimana dijamin dalam ketentuan hukum nasional. Selain itu, penyimpangan dalam merariq dapat menyebabkan tekanan psikologis, kerentanan ekonomi, serta risiko kesehatan reproduksi bagi perempuan yang dinikahkan sebelum mencapai usia dewasa. Untuk mengharmoniskan tradisi merariq dengan perlindungan hukum, diperlukan revitalisasi nilai adat Sasak, pembentukan regulasi desa mengenai tata cara merariq yang berperspektif perlindungan, serta penguatan peran pemerintah desa sebagai mediator dan pengawas pelaksanaan adat di tingkat komunitas. Upaya tersebut harus melibatkan tokoh adat, tokoh agama, masyarakat, dan keluarga guna memastikan bahwa merariq tetap dilaksanakan sesuai dengan nilai budaya tanpa mengabaikan martabat serta hak-hak perempuan dan anak yang wajib dilindungi.
