Abstract

This study analyzes the abuse of authority in the discretionary sugar import policy of the Minister of Trade as examined in Decision Number 34/Pid.Sus- TPK/2025/PN Jakarta Pusat. The research aims to determine whether the policy exceeded the limits of administrative discretion and fulfilled the elements of corruption under Article 3 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001. Using a normative juridical method with statutory and case approaches, this study examines relevant regulations and court decisions. The findings show that the sugar import policy was implemented without valid national commodity data, proper inter-ministerial coordination, and required technical verification, resulting in market distortion, a decline in domestic sugar prices, and harm to the national economy. Consequently, the policy constitutes policy corruption based on the abuse of authority as regulated in Article 3 of the Anti-Corruption Law. This study recommends strengthening oversight and periodic audits of import policies to prevent future abuse of discretion.
