Abstract

The development of information technology and digital media has created a broad space for society to express opinions, one of which is through satirical content that is frequently used as a means of social criticism. The use of satire that touches upon religious issues often gives rise to legal problems, as it is considered to have the potential to violate provisions concerning religious blasphemy. This situation has generated debate regarding the boundaries between freedom of expression and the protection of religious values. This research aims to analyze the regulation of the elements of religious blasphemy in satirical content based on Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code, as well as to examine the juridical implications of its application on freedom of expression in the digital sphere. This study employs a normative legal research method with statutory and conceptual approaches, supported by an examination of legal doctrines and relevant legislation, including the 1945 Constitution of the Republic of Indonesia, Presidential Decree Number 1/PNPS/1965, Law Number 39 of 1999 on Human Rights, Law Number 1 of 1946 concerning the Criminal Code, and Law Number 1 of 2024 concerning Electronic Information and Transactions. The regulation of the elements of religious blasphemy in the legislation still leaves normative ambiguity, particularly in distinguishing between satirical expression that is protected as freedom of expression and acts that may be classified as criminal offenses.
