Abstract

The study is entitled “An Analysis of Article 64 of Law No. 23/2014 Based on the Principle of Non-Discrimination.” The focus of this study is to examine the legal regulation of the relevant phrase as stipulated in Article 61 paragraph (2) and Article 64 paragraph (5) of Law Number 24 of 2013, and to assess its conformity with the principle of non-discrimination as enshrined in Article 22 of Law Number 39 of 1999 on Human Rights. The research employs a normative legal research method, using both statutory and conceptual approaches. The findings indicate that the phrase “religions that have not yet been recognized” is not fully consistent with the constitutional guarantees of freedom of religion and belief as protected under the 1945 Constitution of the Republic of Indonesia, and has the potential to give rise to administrative discrimination against adherents of beliefs outside the six officially recognized religions. This study concludes that there is a need for the reformulation of the statutory provisions and the development of more inclusive implementing guidelines in order to ensure that every citizen receives equal treatment in population administration, in accordance with the principle of non-discrimination.
