Abstract

The application of Restorative Justice in the termination of prosecution constitutes a criminal law enforcement policy aimed at realizing substantive Justice through recovery, particularly in cases of minor criminal offenses. This research aims to analyze the legal basis of the Attorney General’s authority and the mechanism for determining the types of criminal offenses that may be resolved through a Restorative Justice approach. The research employs a normative legal research method with statutory and conceptual approaches. The results indicate that the authority to terminate prosecution based on Restorative Justice is grounded in the principle of opportunity and prosecutorial discretion inherent in the Attorney General as Dominus Litis, as regulated under Attorney General Regulation Number 15 of 2020. The determination of eligible cases is conducted through structured, hierarchical administrative stages and specific substantive standards, ensuring that it does not constitute individual discretion of public prosecutors. Minor criminal offenses that may be resolved through Restorative Justice are determined based on the low level of seriousness of the offense, relatively light criminal sanctions, limited and recoverable losses and social impacts, while also taking into account the consent of the victim and the attitude of the offender. This research concludes that the implementation of Restorative Justice represents a prosecutorial policy that is integrated into the modern criminal Justice system while continuing to ensure legal certainty and institutional accountability within the prosecution service.
