Abstract

Corruption is an extraordinary crime that harms state finances and disrupts economic stability and social justice. Plea bargaining as a criminal case resolution mechanism offers a new approach in Indonesia’s criminal justice system, which has long been formal and time-consuming. In the context of corruption classified as an extraordinary crime, implementing Plea bargaining has the potential to accelerate judicial processes while enhancing state asset recovery effectiveness. This mechanism enables prosecutors and defendants to agree on lighter sentences in exchange for guilty pleas. Thus, Plea bargaining not only alleviates court backlogs but also strengthens the focus on recovering state losses as the main priority. Furthermore, Plea bargaining improves judicial budget efficiency, reduces detention costs, and builds public trust in fair and transparent law enforcement. Integrating Plea bargaining into criminal procedure law will create a more responsive justice system to modern corruption challenges and support economical judicial principles that save costs and time while prioritizing swift resolution for legal certainty and optimal asset recovery.
