Abstract

Pemalsuan Buku Pemilikan Kendaraan Bermotor (BPKB) merupakan salah satu bentuk tindak pidana yang marak terjadi karena nilai ekonomisnya yang tinggi sehingga dapat digunakan sebagai jaminan kredit. Penelitian ini didasari karena putusan Pengadilan Negeri Kendal Nomor 21/Pid.B/2022/PN Kdl yang memutus bebas terdakawa dalam perkara pemalsuan BPKB meskipun jaksa penuntut umum mendakwanya berdasarkan Pasal 263 KUHP. Penelitian ini bertujuan untuk menganalisis (1) kedudukan terdakwa dalam tindak pidana pemalsuan BPKB, serta (2) pertimbangan hukum hakim yang memutus bebas terdakwa dalam perkara tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Sumber data terdiri dari bahan hukum primer seperti Kitab Undang-undang Hukum Pidana (KUHP) dan putusan pengadilan, serta bahan hukum sekunder berupa literatur hukum dan pendapat para ahli. Hasil penelitian ini menunjukkan bahwa terdakwa tidak terbukti secara sah dan meyakinkan melakukan perbuatan meniru atau memalsukan BPKB sebagaimana dimaksud dalam Pasal 263 KUHP terdakwa hanya berperan sebagai penyedia BPKB asli tanpa Surat Tanda Nomor Kendaraan (STNK) dan kendaraanya, tanpa keterlibatan langsung dalam pemalsuan isi dokumen. Hakim mempertimbangkan tidak terpenuhinya unsur delik dan menerapkan asas in dubio pro reo, sehingga terdakwa diputus bebas.
