Abstract

The changing relationship between work and family life in modern society calls for labour law regulations that are increasingly responsive to human rights values, particularly in recognising the right to paternity leave for male workers. In practice, however, the regulation of paternity leave in Indonesia remains limited and has not yet fully positioned fathers as essential actors in child caregiving. This condition gives rise to legal issues concerning the status and protection of paternity leave rights for male workers. Accordingly, this research formulates two main legal questions: first, how the paternity leave right is regulated and analysed from a juridical perspective within the labour law system; and second, how this right is viewed from a human rights perspective. This study aims to examine the legal regulation of paternity leave and to assess its compatibility with human rights principles. The research employs a normative legal method using statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary sources collected through library research and analysed normatively. The findings indicate that paternity leave was initially treated merely as leave granted for specific reasons with a very limited duration, which has not adequately reflected the recognition of fathers’ roles in child caregiving. Although there have been normative developments acknowledging spousal accompanying leave, the substance of its regulation has not yet fully embodied the principles of gender equality and non-discrimination. This research concludes that paternity leave has not been fully positioned as a human right inherent to male workers, highlighting the need for stronger legal norms to ensure the protection of family rights and the achievement of a substantive balance between work and family life.
