Abstract

Concurrent with the ongoing advancement of digital technologies, the fulfillment of the right to information and freedom of expression can be realized through the internet. In a democratic state governed by the rule of law, the internet plays a strategic role in the protection of human rights. However, state policies that restrict internet access, particularly in security-related situations such as military areas, raise legal issues concerning the limits of state authority and the guarantee of citizen’s rights protection. This research seeks to examine the significance of the right to internet access from a human rights standpoint, along with its limitation of restriction under national and international law. This study applies a normative legal research methodology that incorporates statutory, conceptual, and case-based approaches. The analysis examines relevant laws and regulations, international human rights instruments, and the Decision of the PTUN Jakarta Number 230/G/TF/2019/PTUN.JKT. The results of the analysis indicate that the right to internet access constitutes an important part of the right to information and freedom of expression as guaranteed by the constitution and recognized as part of international human rights. However, positive law in Indonesia has not explicitly regulated comprehensive restrictions on internet access. This situation allows for potential human rights violations if such restrictions are not implemented in accordance with the principles of legality, necessity, and proportionality. Therefore, more transparent and accountable regulations are required to ensure that restrictions on internet access remain consistent with the principles of the rule of law and the protection of human rights.
