Abstract

Rape can occur both within and outside of marriage. In law enforcement, rape outside of marriage is considered a common crime, while rape within marriage is considered a complaint-based crime. In reality, not all cases of marital rape are immediately effective if action is taken after the victim files a complaint. Sometimes, victims are reluctant to file a complaint due to various factors, such as economic, psychological, and social (pressure from the surrounding community). This research formulates two problem formulations, the first is how the meaning of violence contained in Article 473 paragraph (1) is related to Article 473 paragraph (6) of the National Criminal Code? Second, what are the characteristics to determine when a criminal act of complaint offense can be changed into an ordinary crime. This research found that basically, there is no difference in the meaning of violence that occurs inside or outside of marriage. Violence can include direct physical contact with the victim's body as well as emotional. In relation to this, it can be concluded that there are no special characteristics that can be used to determine the change of a complaint offense into an ordinary crime. However, the author concludes that we can be guided by Article 1 Number and Article 108 paragraph (1) of the Criminal Procedure Code and that when someone sees or knows of a criminal act, whether it is in progress, has occurred, or will occur, then that person has the right to report it to the authorities.
