Abstract

Judges, as the executors of judicial power, have broad and independent authority to examine, adjudicate, and decide cases. However, this authority has the potential to be abused if it is not balanced with integrity and adequate oversight. One form of deviation that can occur is moral hazard.Although the term moral hazard is better known in the field of economics, this concept is relevant to be studied in the judicial system, particularly in relation to judges' decisions. This study aims to analyze the influence of moral hazard in judges' decisions and to examine judges' decisions influenced by moral hazard in the perspective of the principles of fair trial and substantive justice in the judicial system in Indonesia. The research method used is normative legal research with a legislative, conceptual, and case approach. Legal materials were obtained through literature studies covering legislation, court decisions, books, and scientific journals. The results of the study show that moral hazard can influence judges' considerations and decisions due to weak supervision and unclear norms regarding the limits of judicial independence. Judicial decisions influenced by moral hazard are formally valid, but substantively violate the principles of fair trial, justice, and judicial integrity. This condition has an impact on the decline in Public trust in the judiciary. Therefore, it is necessary to strengthen oversight, enforce the code of ethics for judges, and reform the law in order to prevent moral hazard and maintain the integrity of judicial power.
