Abstract

This research examines legal liability arising from the unauthorized use of copyrighted songs in concert performances. The issues addressed include the legal responsibility of singers as performing artists and the determination of the primary party liable for copyright infringement in commercial concerts, particularly in Decision Number 92/Pdt.Sus-HKI/Hak Cipta/2024/PN Niaga Jakarta Pusat. This study employs a normative juridical method by analyzing statutory regulations and relevant court decisions. The findings indicate that singers have a legal obligation to ensure that the songs performed have obtained permission from the creator or through a Collective Management Organization (CMO). However, the principal legal responsibility should rest with the concert organizer or promoter, as the party that organizes the event, controls its commercial aspects, and derives economic benefits from the concert. The elements of copyright infringement in this case are fulfilled, namely the use of a protected work, without authorization, for commercial purposes, resulting in economic loss to the copyright holder. Therefore, effective copyright protection in concert performances requires a proportional allocation of liability to ensure fairness and legal certainty within the music industry.
