Abstract

Perkembangan teknologi informasi dan media sosial, khususnya TikTok, telah mendorong penggunaan influencer sebagai sarana promosi produk kecantikan. Namun, ulasan produk yang disampaikan secara tidak benar, menyesatkan, atau tanpa dasar fakta berpotensi menimbulkan kerugian bagi pelaku usaha, baik secara materiil maupun immateriil. Permasalahan yang dikaji dalam penelitian ini adalah bentuk pertanggungjawaban hukum influencer atas ulasan produk kecantikan yang tidak benar di TikTok serta upaya hukum yang dapat ditempuh oleh pihak yang dirugikan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, melalui studi kepustakaan terhadap KUHPerdata, KUHP Baru 2023, Undang-Undang Informasi dan Transaksi Elektronik, serta Undang-Undang Perlindungan Konsumen. Hasil penelitian menunjukkan bahwa influencer dapat dimintai pertanggungjawaban hukum secara perdata berdasarkan Pasal 1365 KUHPerdata apabila ulasan yang disampaikan menimbulkan kerugian akibat perbuatan melawan hukum. Selain itu, secara pidana, influencer dapat dikenai sanksi apabila ulasan tersebut mengandung unsur penyerangan kehormatan atau pencemaran nama baik sebagaimana diatur dalam Pasal 433 KUHP Baru 2023 dan Pasal 27A UU ITE. Penelitian ini menegaskan pentingnya tanggung jawab hukum influencer guna menciptakan kepastian hukum, perlindungan bagi pelaku usaha, serta etika dalam ruang digital.
