Abstract

Legal protection is a fundamental aspect of ensuring fair law enforcement as stipulated in Article 28 D paragraph (1) of the 1945 Constitution of the Republic of Indonesia, which affirms the right of every person to protection and certainty of fair law. Legal protection requires legal certainty because when the perpetrator suffers from a mental disorder, their actions are impaired, raising the question of whether or not the perpetrator should be held criminally responsible. This study aims to determine the form of legal protection for victims of crimes committed by perpetrators with mental disorders from the perspective of restorative justice (RJ) and the principle of accountability of perpetrators with mental disorders based on restorative justice. This research uses a normative juridical method with primary legal materials in the form of laws and relevant regulations and secondary materials in the form of books and scientific works related to the topic. Research results show that legal protection for victims can be obtained through the Restorative Justice method using mediation outside of court. Victims can receive compensation for their losses from the perpetrator through their family in the form of restitution or compensation as stipulated in Articles 7A and 7B of Law No. 31 of 2014 concerning Witness and Victim Protection. Restorative Justice does not violate or negate the principle of “no crime without fault” as reflected in Article 44 of the Criminal Code, but rather strengthens the accountability of perpetrators through a recovery mechanism. In addition, for perpetrators with mental disorders who cannot be held criminally responsible, measures may be imposed in accordance with Article 39 of Law No. 1 of 2023 without eliminating the obligation of restoration that may be imposed on the family. In conclusion, Restorative Justice can be an alternative to criminal case resolution that still guarantees justice and restoration for victims.
