Abstract

Penelitian ini membahas mengenai penangkapan Advokat yang dilakukan tanpa melalui mekanisme pemeriksaan kode etik terlebih dahulu, yang menimbulkan persoalan serius dalam konteks penegakan hukum dan perlindungan profesi Advokat di Indonesia. Advokat sebagai salah satu unsur penegak hukum memiliki kedudukan yang sejajar dengan aparat penegak hukum lainnya dan berperan penting dalam menjamin tegaknya prinsip keadilan serta due process of law. Namun, dalam praktiknya, masih ditemukan kasus di mana Advokat ditangkap atau ditahan tanpa melalui mekanisme etik sebagaimana diatur dalam Undang-Undang Nomor 18 Tahun 2003 tentang Advokat dan Kode Etik Advokat Indonesia. Penelitian ini bertujuan untuk menganalisis secara yuridis dan normatif implikasi hukum terhadap tindakan penegak hukum yang mengabaikan prosedur etik tersebut, serta menilai sejauh mana perlindungan hukum bagi Advokat telah diimplementasikan sesuai asas independensi profesi. Melalui pendekatan perundang-undangan, konseptual, dan studi kasus, hasil penelitian menunjukkan bahwa penangkapan Advokat tanpa melalui mekanisme kode etik terlebih dahulu merupakan bentuk pelanggaran terhadap prinsip due process of law dan berpotensi melemahkan independensi profesi Advokat sebagai penegak hukum yang bebas dan mandiri. Temuan ini menegaskan perlunya penguatan mekanisme etik dan koordinasi kelembagaan antara organisasi Advokat dan aparat penegak hukum guna menjaga keseimbangan antara penegakan hukum dan perlindungan profesi Advokat dalam sistem hukum Indonesia.
