Abstract

Amicus Curiae ( sahabat pengadilan ) adalah seseorang atau kelompok yang bukan dari para pihak yang berperkara akan tetapi memiliki kepentingan dalam perkara tersebut. Amicus Curiae biasa digunakan dalam proses pembuktian suatu perkara yaitu dengan mengajukan secara perorangan atau kelompok untuk memberikan suatu pendapat atau informasi terhadap perkara yang sedang terjadi di persidangan agar dalam suatu proses perkara pendapat atau informasi Amicus Curiae membantu pengadilan dalam hal penyelesaian masalah. Tujuan penelitian ini yaitu untuk mengetahui sejauh mana kekuatan amicus curiae digunakan sebagai alat bukti dalam sistem peradilan pidana. Metode Penelitian yang digunakan yaitu menggunakan metode penelitian hukum normatif dengan metode pendekatan Perundang-undangan ( statute approach ) adalah penelitian hukum dengan cara menelaah semua peraturan perundang-undangan dan regulasi yang relevan dengan isu hukum yang sedang diteliti, pendekatan konseptual (conceptual approach ) adalah metode atau cara kerja yang dimulai dari konsep-konsep, ide-ide, atau doktrin yang ada, dan kemudian digunakan untuk memahami, menganalisis, atau menjelaskan suatu masalah atau subjek, misalnya dalam ilmu hukum serta pendekatan kasus (case approach ) adalah Pendekatan yang dilakukan menganalisis, menelaah digunakan sebagai pedoman bagi permasalahan hukum untuk menyelesaikan perkara hukum. Hasil Penelitian menunjukan bahwa amicus curiae tidak bisa dikategorikan sebagai alat bukti yang sah dalam sistem peradilan pidana Indonesia. Amicus curiae belum mempunyai kekuatan pembuktian dalam sistem peradilan pidana Indonesia akan tetapi kekuatan pembuktian berada pada keyakinan hakim karena amicus curiae hanya sebatas sukarela mengajukan.
