Abstract

This study discusses the issue of the authority of the House of Representatives (DPR) in regulating the offense of insulting the President after the provision was overturned by the Constitutional Court through Decision Number 013-022/PUU-IV/2006. The decision essentially affirms that criminalizing criticism of the President is not justified in a democratic country, but does not preclude the possibility of re-regulation as long as it complies with constitutional limits. This raises the question of whether the DPR still has the authority to reformulate the offense, and how the Constitutional Court's decision stands in the formation of a new norm that is similar in substance to the norm that has been overturned. This research is normative legal research using a legislative approach, a conceptual approach, and a case approach. The legal materials used are primary, secondary, and tertiary legal materials. The results of the study show that the DPR still has constitutional authority to re-regulate the offense of insulting the President because the authority to formulate laws is a direct attribution of the 1945 Constitution of the Republic of Indonesia. However, this authority is not unrestricted, but is strictly limited by constitutional parameters that have been confirmed by the Constitutional Court. Constitutional Court decisions have binding force that is not only negative (invalidating norms), but also positive as substantive guidelines that must be used as a reference in the formulation of new norms.
