Abstract

Outing class activities are generally carried out by schools as part of the national curriculum, which benefits students by increasing their creativity and fostering their character in relation to their surroundings, in accordance with Law Number 20 of 2003 concerning the National Education System. However, legal issues have emerged where outing class activities result in fatalities, especially in cases where these activities occur. The results showed that when fatalities occur during an outing class activity, the elements of a tort must be considered. Outing class activities that result in fatalities due to negligence can be considered a tort. Legal efforts are needed to protect victims and their families, provide them with legal certainty, and demand compensation for material and non-material damages resulting from these activities.
