Abstract
Anak merupakan generasi penerus suatu bangsa, hal ini wajib bagi negara harus menjamin perlindungan anak guna tercapainya kesejahteraan anak. Namun, seringkali memang negara dihadapkan oleh fenomena masalah terkait perlindungan anak, salah satunya adalah permasalahan seks bebas oleh anak. Sebagai bentuk perlidnungan anak, maka negara memastikan bahwa anak juga perlu mendapatkan upaya kesehatan reproduksi. Hal ini telah tercantum dalam Pasal 103 Ayat (4) huruf e Peraturan Pemerintah Nomor 28 Tahun 2024 tentang Peraturan Pelaksana Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, bahwa penyediaan alat kontrasepsi merupakan salah satu bagian dari upaya kesehatan reproduksi bagi anak. Penelitian ini akan merekonstruksi dan menganalisa terkait urgensi rekonstruksi penyediaan alat kontrasepsi bagi anak dalam perspektif perlindungan anak, dengan mempertimbangan segala aspek moral serta pelaksanaan perlindungan anak yang baik semata-semata berpacu pada Pancasila sebagai pandangan hidup dan cita-cita moral bangsa. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif, yaitu metode yang menganalisis hubungan dan penyelarasan antara asas hukum, norma hukum, dan pendapat sarjana (teori-teori) serta aturan lainnya terkait dengan pokok masalah yang akan dibahas untuk menjawab isu hukum yang dihadapi.
