Abstract

The development of information technology has facilitated the exchange and access to information, while simultaneously giving rise to risks concerning the protection of personal data and individual privacy rights, including those of public officials. In Indonesia, the Right to be Forgotten has gained relevance through the provisions of Article 26 paragraph (3) of Law of the Republic of Indonesia Number 19 of 2016 concerning the Amendment to Law Number 11 of 2008 on Electronic Information and Transactions, which imposes an obligation on electronic system operators to delete irrelevant information based on a court order. This research examines whether such provision can genuinely be classified as the Right to be Forgotten and whether the implementation of the Right to be Forgotten potentially conflicts with the principle of public information disclosure, particularly in relation to public officials. This study employs a normative juridical research method using statutory, conceptual, and comparative approaches, with reference to European Union regulations and practices in France. The findings indicate that Article 26 paragraph (3) of Law of the Republic of Indonesia Number 19 of 2016 concerning the Amendment to Law Number 11 of 2008 on Electronic Information and Transactions does not fully reflect the concept of the Right to be Forgotten as regulated under the General Data Protection Regulation (GDPR), particularly due to the requirement of a court determination, which limits its effectiveness. Consequently, the regulation of the Right to be Forgotten would be more appropriately situated within the personal data protection regime under Law of the Republic of Indonesia Number 27 of 2022 on Personal Data Protection. Furthermore, the application of the Right to be Forgotten has the potential to conflict with the principle of public information openness if it is used as a means to erase the digital records of public officials related to matters of public interest. Therefore, the implementation of the Right to be Forgotten must be conducted in a proportional manner and must not diminish the public’s right to access public information, particularly in order to ensure the sustainability of good governance with respect to public officials.
