Abstract

Dual office-holding by ministers has become a significant issue in the administration of the Indonesian government, particularly after the enactment of Law Number 39 of 2008 on State Ministries and its amendments. Although Article 23 of the law regulates the prohibition for ministers to concurrently hold positions as other state officials, company commissioners, or leaders of organizations receiving funding from the state or regional budget (APBN/APBD), the provision does not explicitly include positions within political parties. This situation creates multiple interpretations and opens opportunities for conflicts of interest, abuse of power, and the weakening of good governance principles. In fact, political parties normatively also receive state funding, thus substantively falling within the scope of the dual office-holding prohibition. This condition demonstrates the presence of vague norms that require further examination to ensure legal certainty and maintain the integrity of state administrators. The research problem focuses on the clarity of regulations concerning the prohibition of dual office-holding by ministers, particularly when a minister simultaneously holds a position within a political party structure, as well as its implications for the legality principle and potential conflicts of interest in governmental administration. The study employs a normative legal research method through statutory, principle-based, and doctrinal approaches by examining Law Number 39 of 2008, and provisions on political party funding under Law Number 2 of 2011. The findings show that Article 23 of Law Number 39 of 2008 does not explicitly prohibit ministers from holding positions in political parties, even though political parties receive financial support from the state. This ambiguity creates vague norms and opens space for multiple interpretations. Such conditions have the potential to generate conflicts of interest, abuse of power, and weaken the principles of good governance. Therefore, regulatory strengthening is needed to provide legal certainty and ensure consistent application of the legality principle in governmental administration.
