Abstract

The phrase “harming the state’s economy” in Articles 603 and 604 of Law No. 1 of 2023 on the Indonesian Criminal Code presents a legal problem because it lacks clear normative boundaries. This ambiguity results in differing interpretations among law enforcement authorities and leads to inconsistencies in the application of this criminal element. This research is a normative legal study employing a statutory approach and a conceptual approach. The analysis is conducted through grammatical, prescriptive, and authentic interpretation to assess the scope of meaning of the phrase. The findings show that the phrase has an overly broad coverage and does not provide adequate operational limits. This condition leads to violations of the lex certa principle, difficulties in evidentiary practice, and disparities in court decisions, ultimately weakening legal certainty in the handling of corruption cases. Reformulation is required so that this element can be applied consistently and in accordance with the principle of legal certainty.
