Abstract

Saat ini korban kekerasan seksual di Indonesia memiliki peluang mendapatkan ganti kerugian lewat restitusi yang dibebankan kepada pelaku kekerasan. Namun sayangnya implementasi restitusi masih bermasalah (belum eksekutable), mulai dari kendala pengajuan permohonan restitusi, mekanisme perhitungan restitusi yang memakan waktu lama sejak diajukan oleh korban, kendala koordinasi antar institusi dalam pelaksanaan sita harta sebagai jaminan pembayaran resitusi, hingga prosedur lelang harta yang menemukan hambatan struktural sehingga hak korban tidak terpenuhi secara komprehensif. Dana Bantuan Korban (Victim Trust Fund) merupakan salah satu trobosan perlindungan hukum bagi korban kekerasan Seksual yang telah diatur dalam Pasal 35, UU No. 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (TPKS) yang Sumber pendanaannya, berasal dari filantropi, Masyarakat, Individu, tanggungjawab sosial dan lingkungan perusahaan, dan sumber lain yang sah dan tidak mengikat. Sebagai solusi dalam hal harta kekayaan terpidana yang disita tidak mencukupi biaya Restitusi maka negara memberikan kompensasi sejumlah Restitusi yang kurang bayar kepada Korban sesuai dengan putusan pengadilan. Sementara konsep penyaluran dana Kompensasi melalui mekanisme Dana Bantuan Korban (DBK) sangat urgen untuk diatur lebih teknis melalui Peraturan Pemeritah (PP) yang mencakup pengaturan sumber pendanaan, peruntukan, dan pemanfaatan untuk membayar kompensasi sejumlah resitusi kurang bayar, termasuk mengatur penerimaan bukan pajak (PNPB) hasil sanksi pidana finansial yang didapatkan dari proses peradilan dapat berkontribusi pada DBK.
