Abstract

Tanah merupakan sumber daya vital yang memiliki nilai strategis dalam pembangunan nasional dan kehidupan masyarakat Indonesia. Dalam konteks hukum, jaminan kepastian atas kepemilikan tanah diwujudkan melalui sistem pendaftaran tanah yang diatur dalam Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA) dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Namun, dalam praktiknya, sering ditemukan Sertifikat Hak Milik (SHM) yang tidak sesuai dengan riwayat tanah, sehingga memicu sengketa kepemilikan. Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan riwayat tanah dalam pembuatan SHM dan bagaimana bentuk perlindungan hukum terhadap pemilik SHM yang berusaha mempertahankan haknya. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan terdiri atas bahan hukum primer berupa peraturan perundang-undangan terkait, bahan hukum sekunder seperti literatur dan jurnal hukum, serta bahan hukum tersier berupa kamus dan ensiklopedia hukum. Hasil penelitian menunjukkan bahwa riwayat tanah memegang peran penting dalam menentukan keabsahan penerbitan SHM. Perlindungan hukum diberikan dalam bentuk preventif dan represif, melalui sistem administrasi pertanahan yang ketat serta mekanisme peradilan apabila terjadi sengketa.
