Abstract

Penelitian ini mengkaji perlindungan kesehatan dan keselamatan pekerja tambang uranium di Indonesia dari paparan zat radioaktif melalui pendekatan hukum normatif. Latar belakang penelitian didasari oleh potensi risiko kesehatan jangka panjang akibat paparan radiasi dalam industri pertambangan uranium, sementara regulasi nasional dinilai belum komprehensif dan selaras dengan standar internasional seperti IAEA dan ILO. Metode penelitian menggunakan metode penelitian hukum normatif (Undang-Undang Ketenagakerjaan, Peraturan BAPETEN) dan instrumen internasional (Konvensi IAEA, ILO) untuk mengidentifikasi kesenjangan regulasi. Hasil penelitian menunjukkan fragmentasi kerangka hukum Indonesia, ketiadaan spesifikasi proteksi radiologis dalam UU Ketenagakerjaan, serta kelemahan implementasi prinsip ALARA dan batas paparan radiasi. Selain itu, ditemukan ketiadaan mekanisme kompensasi, perlindungan hukum bagi pekerja, dan tanggung jawab mutlak perusahaan. Sebagai rekomendasi, penelitian menyarankan harmonisasi regulasi dengan standar IAEA, penyusunan peraturan khusus pertambangan uranium, pembentukan inspektorat khusus, peningkatan kapasitas SDM, serta rekomendasi perlindungan K3. Implikasi penelitian menekankan pentingnya integrasi aspek teknis, hukum, dan hak asasi manusia untuk menjamin lingkungan kerja aman serta keberlanjutan industri pertambangan di Indonesia.
